Purpose of the website

Personal website of the musician Brian Cristopher, providing information about live and online performances, bookings, free music to stream and download, and ways to get in touch.

VAT

As a small business, services may be exempt from VAT under the Austrian small-business VAT scheme; where this applies, no VAT is shown and none is charged.

Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr. My email address for this purpose is [email protected]. I am neither obliged nor generally willing to take part in dispute resolution proceedings before a consumer arbitration board.

Liability for content

The content of this website has been prepared with care. However, I cannot guarantee that all information is accurate, complete or up to date. As a service provider I am responsible for my own content on these pages under general law, but I am not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate unlawful activity.

Liability for links

This website contains links to external websites operated by third parties, over whose content I have no control. I therefore accept no liability for this third-party content. The respective provider or operator of the linked pages is always responsible for their content. If I become aware of any legal infringements, I will remove the relevant links promptly.

The music, recordings, text, images and other material created by me on this website are protected by copyright. The free albums offered here may be downloaded and listened to for personal use; any other reproduction, distribution or commercial use requires my prior written consent. Privacy Policy

§1  General

Your personal data (e.g. name, address, email address, phone number) is processed by me only in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act. The sections below inform you about the nature, scope and purpose of the collection and use of personal data on this website. The controller responsible for data processing is Brian Hornsey (contact details in the Legal Notice above). This privacy policy applies only to this website; if you follow links to other sites, please refer to their own privacy information.

§2  Data you provide (contact & bookings)

If you contact me by email or phone, or send an enquiry to book a gig or request a song, the data you choose to provide (such as your name, email address and message) is used solely to handle your enquiry and any resulting arrangement. The legal basis is Art. 6(1)(b) GDPR (steps prior to and performance of a contract) and Art. 6(1)(f) GDPR (my legitimate interest in responding to you). This data is not passed to third parties outside what is necessary to answer you, and is deleted once it is no longer needed, subject to any statutory retention periods under tax and commercial law.

§3  Hosting & server log files

This website is hosted on Cloudflare Pages (Cloudflare, Inc.). When you visit the site, the hosting provider automatically processes technical information that your browser transmits, including your IP address, for the purpose of delivering the site securely and reliably. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in a secure, functioning website). Cloudflare acts as a processor on my behalf; data may be processed on servers outside the EU under the appropriate safeguards provided by Cloudflare.

§4  Third-party services

(a) Google Fonts. This site currently loads two fonts (Quicksand and Work Sans) from Google’s servers (Google Ireland Ltd. / Google LLC). When a page loads, your IP address is transmitted to Google so the fonts can be delivered. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in consistent presentation).

(b) YouTube. This site embeds a video from YouTube (Google Ireland Ltd. / Google LLC). When a page containing the embed loads, a connection to YouTube/Google is established and cookies may be set by YouTube. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in presenting performances). Please refer to Google’s privacy policy for details of their processing.

(c) Payment & donation links. The site links to PayPal and Donorbox for optional tips and donations. No payment is processed on this website itself; only if you click through and choose to pay is your data handled by those providers under their own privacy policies.

Beyond the above, this website uses no analytics, no advertising and no tracking cookies of its own. The only cookies that may be set are those from the YouTube embed described in (b).

§5  Your rights

Under the GDPR you have the right to access your personal data and to request its rectification, erasure or restriction, the right to data portability, and the right to object to processing based on legitimate interest. To exercise any of these, email [email protected]. You also have the right to lodge a complaint with the Austrian Data Protection Authority (dsb.gv.at).
